1. Introduction

NavigateAI, Inc. ("the Company," "we," "us," or "our") operates naivgate.org and the NavigateAI mobile application (together, the "Service"). The Service guides field crews through photo evidence capture, AI-assisted inspection sequences, and punch-list close-out on site. This Privacy Policy describes what personal information we collect, how we use it, and your choices regarding that information.

2. Information We Collect

2.1 Information You Provide

When you create an account or use the Service, you provide information such as:

  • Account details: name, email address, phone number, employer, and job role;
  • Property and job-site information: property address, site name, client or owner name, and job context submitted for inspection work;
  • Inspection records: punch-list items, findings, task descriptions, and written notes entered during field sessions;
  • Messages sent to our support team at [email protected] or through in-app contact forms.

2.2 Information Collected Automatically

When you use the Service, we automatically collect technical and usage data including:

  • Device type, operating system version, and mobile app or browser version;
  • IP address and approximate city-level location derived from it;
  • GPS coordinates when field crews use location-based work-sequencing features (subject to your device-level permission);
  • Inspection photos and other media uploaded through the app;
  • Pages and screens visited, feature interactions, session duration, and referring URLs;
  • Cookie and similar session identifiers (see Section 5).

2.3 We Do Not Knowingly Collect Children's Data

The Service is intended for professional use by adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, contact [email protected] and we will promptly delete it.

3. How We Use Information

We use collected information to:

  • Operate the Service and deliver AI-guided inspection sequences and punch-list close-out tools to field crews;
  • Generate inspection summaries, photo evidence records, and sequential work-order outputs for crews and their clients;
  • Maintain crew accounts, preserve job history, and support data export to project management systems;
  • Send service notifications, product updates, and (with your consent where required) marketing communications;
  • Detect and prevent unauthorized access, fraud, and abuse;
  • Comply with applicable legal obligations.

We do not sell personal information for monetary value. Where applicable state law treats certain advertising arrangements as a "sale" or "share," see your state's section below.

4. Sharing of Information

We share personal information only in these circumstances:

  • With service providers acting on our behalf (cloud infrastructure, transactional email, and product analytics) under contractual data-processing terms limiting their use;
  • With your organization's designated account administrator, if you use the Service under a business or team plan;
  • With law enforcement or regulators when required by law, court order, or to protect the rights, safety, or property of the Company or others;
  • With a successor entity in connection with a merger, acquisition, or asset sale, subject to this Policy.

We do not sell personal information to third parties.

5. Cookies and Tracking

We use cookies and similar technologies to operate the site and app, store your preferences, and measure usage. For details and your choices, see our Cookie Policy.

6. Data Retention

We retain personal account data for the duration of your active subscription and for up to 12 months after account closure, to allow for reactivation and to resolve any outstanding disputes. Inspection photos and job records follow the same schedule unless you request earlier deletion. Inactive marketing contacts are purged after 24 months. Server access logs are retained for 90 days and then aggregated.

7. Security

We apply administrative, technical, and physical safeguards designed to protect personal information, including TLS encryption in transit, restricted-access databases, and role-based access controls. No system is perfectly secure; we cannot guarantee absolute security.

8. Your General Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, or limit processing of your personal information. To submit a request, email [email protected]. We respond within the timeframe required by applicable state law.

9. Colorado Residents (CPA)

Under the Colorado Privacy Act ("CPA"), Colorado residents have the following rights with respect to personal data we control.

9.1 Your CPA Rights

  • Right of Access: confirm whether we are processing your personal data and obtain a copy.
  • Right to Correction: correct inaccuracies, considering the nature and purposes of processing.
  • Right to Deletion: request deletion of personal data concerning you.
  • Right to Data Portability: obtain a portable copy where technically feasible (up to twice per year).
  • Right to Opt Out: opt out of (a) targeted advertising, (b) sale of personal data, and (c) profiling that produces legal or similarly significant effects.

9.2 Universal Opt-Out Mechanism

We honor browser-transmitted universal opt-out signals, including the Global Privacy Control ("GPC"), as a request to opt out of sale and targeted advertising. Configuring GPC in your browser is sufficient; no separate request is required.

9.3 How to Exercise

Submit a request by emailing [email protected]. We respond within 45 days; one 45-day extension is available where reasonably necessary, with notice.

9.4 Appeal

You may appeal a denial by replying to our response email. If we maintain the denial, you may contact the Colorado Attorney General at coag.gov.

9.5 California Visitors

If you are a California resident, you may also exercise the rights granted under the California Consumer Privacy Act ("CCPA") and California Privacy Rights Act ("CPRA"), including the right to know, the right to delete, the right to correct, and the right to opt out of sale or sharing. We do not sell personal information and do not "share" personal information for cross-context behavioral advertising.

10. Changes to This Policy

We may update this Policy periodically. Material changes will be reflected by a new "Last updated" date and, where appropriate, a notice on the Service.
